In Queens, a 65-year-old man was reportedly the target of an attempted mugging in the early hours of the morning. However, the victim is now facing over 24 additional charges after he purportedly shot and killed the assailant. It is important to note that these charges are not directly linked to the fatal shooting.
As per the investigators’ report, Charles Foehner possessed a license for a shotgun and a rifle, however, he lacked the license for the pistol he used and did not have a concealed carry permit. More than two dozen unlicensed firearms were discovered in his home after a judge approved a search warrant.
According to police, Foehner appeared before a judge on Thursday evening to face charges of 25 counts of criminal weapon possession.
Midway through the proceedings, the judge made a surprising decision to recuse herself due to her connections to the case. According to sources, the judge overseeing the case has connections to the search warrant that resulted in the discovery of the guns.
It should be noted that the defendant, Foehner, is not being charged in relation to the shooting and therefore the judge’s ties to other aspects of the case are not included in the charges.
In Kew Gardens, an ordeal began overnight on Wednesday as a man shattered the front door of an apartment building located on 82nd Avenue near Queens Boulevard.
According to witnesses, a man identified by the police as Cody Gonzalez, allegedly caused damage to a call box located in a building’s foyer across the street. The building’s door was found shattered into pieces, causing a commotion that disturbed the sleep of its residents.
According to police, the fatal altercation took place in a driveway near the parking garage of the building at approximately 2 a.m., just minutes after the aforementioned incident. According to reports, Gonzalez attempted to rob Foehner while he was on his way back home.
According to Foehner, a man allegedly threatened him with a sharp object, prompting Foehner to draw a gun he had in his possession. According to police, Foehner’s suspicion of a weapon was actually a pen.
According to a nearby resident, three gunshots were reportedly heard. According to the police, Gonzalez was shot and subsequently succumbed to his injuries.
According to NBC New York, Gonzalez’s aunt stated that her 32-year-old nephew had a mental health condition, but she believed that he did not deserve to lose his life for the attempted mugging.
According to the individual, he never displayed aggression towards people. According to the speaker, the individual in question did not deserve to meet their end in the manner that they did. Iris Gonzalez expressed that it was devastating to them. According to the speaker, the shooting was unnecessary.
According to the aunt, Gonzalez attempted to forcefully enter two apartment buildings while being off his medication. According to other relatives, Foehner’s actions were understandable given the situation.
According to the speaker, if the individual attempted to rob him, the other person is simply acting in self-defense. According to the New York Daily News, Anthony Aguilar, Gonzalez’s cousin, stated that one cannot fault him for protecting himself.
The shooter is not being faulted, according to the statement. There is a widespread sentiment that Cody should have been placed in a psychiatric facility. Another cousin, Stephan Gonzalez, stated that if anything, the state failed him.
According to police, Foehner does not have a criminal record. As she departed the court on Thursday night, his wife declined to comment to the reporters. According to sources, the next arraignment hearing for Foehner has been scheduled for Friday.
